Can you scrap a car that still has finance on it?

If the car is on hire purchase or PCP it belongs to the lender until the last payment, and that changes everything. What the law says, how to get a settlement figure, and the three ways people usually sort it out.
Every week somebody books a collection for a car that still has finance on it — usually because it has failed an MOT badly, or been written off, and the monthly payments are still going out. Whether you can scrap it depends entirely on what kind of finance it is.
Who actually owns the car
With hire purchase (HP) or personal contract purchase (PCP) the finance company owns the car until the agreement has been settled — the final payment on HP, the balloon payment on PCP. You are the registered keeper on the V5C, which is not the same thing as the owner. With a personal loan, a bank loan or a credit card, the car is yours from day one. The loan is just a debt that happens to have paid for a car, and the lender has no claim on the vehicle itself.
That single difference decides the rest of this guide. A car bought with a personal loan can be scrapped whenever you like; you carry on paying the loan. A car on HP or PCP cannot be sold, given away or scrapped without the lender's agreement, because it is not yours to dispose of.
Why you cannot just scrap it and keep paying
Scrapping a financed car does not end the agreement. The payments carry on, the lender can pursue you for the whole balance, and disposing of something you do not own — which is what the law calls it — can be treated as fraud. The finance is also recorded against the registration number, so it shows up on a finance check. A Certificate of Destruction issued for a car the lender still owns is a mess for everyone: you would owe money for a car that no longer exists, and the lender would have a claim against the yard.
Get a settlement figure
Ring the lender and ask for a settlement figure: what it would cost to end the agreement today. It is usually valid for a short window — often ten days — so ask when you are ready to act. Then get the scrap price for the car and compare the two.
If the settlement is less than the scrap price, which happens near the end of an old agreement, the answer is easy: settle, get written confirmation that the agreement is closed, then book the collection and keep the difference.
More often the settlement is higher than the scrap price, and you have to fund the gap. The three routes people take:
Settle it yourself. Pay the settlement, scrap the car, put the scrap money towards it. Painful, but it ends the payments and the interest at once.
Ask the lender what they will accept. Lenders deal with dead cars all the time. Some will agree to the car being scrapped with the proceeds paid to them and the shortfall spread over the remaining months; some will want the car back. Whatever is agreed, get it in writing before anything is collected.
If an insurer has written it off, the insurer pays the lender first out of the settlement and you get whatever is left. If there is nothing left and you have GAP insurance, that is what it is for. Do not accept a scrap offer for a written-off car until the insurer has said what it intends to do — often the insurer keeps the salvage. There is more on this in selling a damaged or written-off car.
Voluntary termination
Hire purchase and PCP agreements regulated by the Consumer Credit Act carry a right to hand the car back once you have paid half of the total amount payable, and owe nothing more. The catch is that the car has to be in reasonable condition for its age and mileage: a car that has been crashed, or is missing parts, will attract a charge for the damage. For a car that is simply tired and past halfway, it is worth asking about before you think about scrap at all.
What the collector will do
Expect to be asked whether there is finance on the car, and expect a check on the registration. A finance marker stops the job until the lender has been paid or has confirmed in writing that the car can be scrapped. That protects you as much as the yard.
The short version
Personal loan: scrap it when you like, keep paying the loan. HP or PCP: speak to the lender first, get a settlement figure, get their agreement in writing, and then book. The price only moves with the metal market while you sort it out, so there is no rush worth getting the paperwork wrong for.
